Terms & Conditions

Marahel is the owner and operator of the FinTax Service (“the Service”). Your use of the Service is expressly conditioned on your acceptance of these FinTax Terms and Conditions (“Terms and Conditions”). By using the Service, you signify that you unconditionally agree and accept to be legally bound by these Terms and Conditions. No other terms or conditions in any document, writing or other communication whatsoever made by you to Marahel or its employees, representatives or agents shall be applicable or binding unless explicitly agreed upon by Marahel in writing.

Marahel reserves the right to alter these Terms and Conditions at any time. Such changes will be effective and legally binding on you when posted on our website or when we use reasonable efforts to notify you by other means. Please review these Terms periodically. Your continued use of the Service after amended Terms and Conditions are posted or otherwise communicated signifies your acceptance of the changes.

A. Marahel hereby grants you a limited, non-exclusive, non-transferable right to use the Service provided that you agree to the following:

i. Marahel may, at its sole and absolute discretion, without prior notice to you and without liability, reject, prevent, discontinue or suspend your account(s) and/or your use of the Service if, at its sole discretion, Marahel is of the opinion that your use does not meet Marahel’s specifications or guidelines, or which Marahel may consider to be inappropriate, illegal, or harmful to its interests. If Marahel exercises its discretion under this paragraph 3.1(a), it shall have no liability to refund any portion of your pre-paid subscriptions, if applicable.

ii. You agree to comply with any policies or guidelines that Marahel may introduce or amend from time to time, including technical specifications, privacy, and acceptable content policies.

iii. You agree not to provide access to or furnish any part of the Service to any third party; modify, disrupt, or interfere with the Service, servers, or networks either manually or through the use of scripts, viruses, or worms; reproduce, duplicate, copy, deconstruct, sell, trade, or resell the Service; or excessively overload the systems used by Marahel to provide the Service.

iv. Marahel may, at its sole discretion, amend, suspend, vary or withdraw the Service, these Terms and Conditions, and/or its website at any time.

v. You shall be solely responsible for your use of the Service and shall indemnify Marahel and hold it harmless from all loss, costs, and damages incurred by Marahel in connection with any claims by third parties relating to your use of the Service or your breach of these Terms and Conditions or any applicable policies or guidelines.

vi. You represent and warrant that you have all necessary rights, consents, licenses, and permits to use any materials, graphics, logos, data, or information you input into the Service (“Your Content”) and that Your Content complies with applicable laws and does not violate any third-party rights.

vii. You represent and warrant that you have the full corporate rights, power, and authority to agree to these Terms and Conditions and that doing so does not violate any law or agreement by which you are bound.

viii. You agree that Marahel may reference your name as a user of the Service in any publicity or marketing unless you request otherwise in writing.

ix. You are responsible for obtaining hardware and software needed to access and use the Service and for any resulting damages from your environment’s operation or compatibility with FinTax.

x. You agree that Marahel is the sole owner of and may use any feedback you provide regarding the Service for improvements and development.

B. Marahel reserves all rights in the Service not expressly granted herein.

C. You hereby grant Marahel a worldwide, royalty-free, non-exclusive license to use, host, reproduce, and adapt Your Content as necessary to provide the Service and to use comments or material you may share in community forums (if applicable).

A. By creating an account and using the Service, you agree to pay applicable fees for the selected services or products, in accordance with Marahel’s payment terms, which may include payment in advance and on a recurring basis.

B. Your subscription may automatically renew unless you cancel before renewal. It is your responsibility to manage and renew your subscription to avoid service interruption.

C. All sums payable may be exclusive of any applicable taxes under KSA law, which you agree to pay in addition to subscription fees.

D. Marahel may charge your registered payment method for fees and applicable taxes.

A. Marahel may terminate your access to the Service without prior notice if you breach these Terms and Conditions. Your ability to use the Service may also terminate upon the expiry of your subscription if not renewed.

B. After termination, Marahel may maintain your data at its discretion but is not obligated to retain your account or data post-termination unless required by law, and you agree to hold Marahel harmless in this regard.

C. If termination is due to non-renewal, you may reactivate your account by renewing your subscription within any applicable grace period.

A. You remain the owner of any data you upload into the Service (“Your Data”). Marahel owns system-generated data and aggregated data from the Service (“Marahel’s Data”) and may use it to improve services and develop new products.

B. Your Data will be stored and processed securely within the Kingdom of Saudi Arabia.

C. The FinTax Privacy Policy, as updated from time to time, is incorporated into and forms part of these Terms and Conditions.

A. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

B. You agree that Marahel may act on instructions from your designated users or administrators unless notified otherwise in writing.

You agree to indemnify and hold harmless Marahel, its affiliates, officers, and employees from any claims, losses, or expenses arising from your use of the Service or breach of these Terms and Conditions.

Marahel aims to maintain reasonable Service availability but does not guarantee uninterrupted access or error-free operation.

UNLESS EXPRESSLY PROVIDED HEREIN, TO THE FULLEST EXTENT PERMITTED BY LAW, MARAHEL MAKES NO WARRANTIES REGARDING THE SERVICE, WHICH IS PROVIDED ON AN “AS IS” BASIS. MARAHEL DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR PURPOSE, AND NON-INFRINGEMENT. MARAHEL DOES NOT WARRANT THAT THE SERVICE WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT IT WILL BE UNINTERRUPTED OR ERROR-FREE.

TO THE FULLEST EXTENT PERMITTED BY LAW, MARAHEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF MARAHEL IS FOUND LIABLE, THE MAXIMUM LIABILITY SHALL NOT EXCEED THE VALUE OF THE LAST MONTHLY SUBSCRIPTION FEE PAID BY YOU FOR THE SERVICE.

MARAHEL SHALL NOT BE LIABLE FOR FAILURE TO PERFORM ITS OBLIGATIONS UNDER THESE TERMS IF SUCH FAILURE IS CAUSED BY EVENTS BEYOND ITS REASONABLE CONTROL, INCLUDING BUT NOT LIMITED TO NATURAL DISASTERS, WARS, STRIKES, OR INTERNET OUTAGES.
